Chapter 1 — Purpose of the Terms of Use

The purpose of these Terms of Use, hereinafter referred to as the “Terms”, is to define the conditions for accessing, browsing and using the Entraide Maritime platform, together with the rights and obligations applicable to its users. Entraide Maritime is a digital platform specialising in the maritime and boating world. Its aim is to bring together, within a single digital environment, private individuals, professionals, companies and, more broadly, the various players in the maritime sector. The Platform is intended, in particular, to progressively offer services for connecting people, employment and recruitment, the publication and consultation of listings, the purchase and sale of boats, maritime services and work, content and training, community exchanges, mutual assistance, as well as support features based on artificial intelligence. The features actually available may change according to the various development phases of Entraide Maritime. The presentation of a service in these Terms therefore does not necessarily mean that it is immediately available on the version of the Platform used by the User. These Terms apply to all users accessing Entraide Maritime, whether they act as private individuals or professionals, subject to the specific provisions that may apply to certain services or categories of user. The use of paid services may also be subject to separate Terms of Sale supplementing these Terms. The rules relating to the processing of personal data, cookies and moderation may also be the subject of specific documents accessible from the Platform.

Chapter 2 — Overview of Entraide Maritime

Entraide Maritime is a digital platform specialising in the maritime and boating sector, designed to bring together various services within a single environment, accessible to private individuals and professionals alike. The Platform aims to make it easier to exchange information, carry out searches, connect with others and access services related to the maritime world. Entraide Maritime is intended to bring together progressively:

  • job offers and job searches in the maritime sector;
  • connections between professionals, companies and private individuals;
  • listings for the purchase and sale of boats;
  • maritime and boating services and work;
  • the educational content and training offered on the Platform;
  • community spaces for exchange, the sharing of experience and mutual assistance;
  • search and matching tools adapted to the various profiles;
  • maritime assistance based on artificial intelligence technologies;
  • as well as the future additional services developed as Entraide Maritime evolves.

The services offered may be available free of charge or, depending on their nature and evolution, be subject to a subscription, a commission, a specific payment or any other arrangement provided for by the applicable Terms of Sale. Entraide Maritime is intended to evolve gradually. Certain features described in these Terms may therefore be added, modified or made available during the various development phases of the Platform. Entraide Maritime acts in particular as a digital environment making it easier to access information, services and connections. Where the Platform connects users, the respective roles and responsibilities of Entraide Maritime and of the users concerned are set out in these Terms and, where applicable, in the specific conditions applicable to the service used.

Chapter 3 — Acceptance and enforceability of the Terms

Accessing and using Entraide Maritime implies compliance with these Terms of Use. When creating an account, the User is invited to read the Terms and to accept them via the mechanism provided by the Platform. This acceptance is a necessary condition for the creation and use of an Entraide Maritime account. The User acknowledges having read these Terms before accepting them and undertakes to comply with them throughout their use of the Platform. The Terms are accessible at all times from Entraide Maritime so that every User can consult them. In the event of a substantial change to these Terms, Entraide Maritime may inform Users and, where necessary, request fresh acceptance before use of the services concerned continues. Any User who refuses the Terms or their amendments, where acceptance is required, may no longer be able to access all or part of the features requiring an account. These Terms are enforceable against the User from the moment they are accepted or, for features accessible without creating an account, on the conditions brought to their attention when using the Platform.

Chapter 4 — Conditions for accessing the platform

Entraide Maritime is accessible to private individuals and professionals wishing to use the services offered in connection with their activities, searches or needs relating to the maritime and boating sector. Certain features of the Platform can be viewed without creating an account. However, access to services requiring identification, publication, a connection, an interaction with other users or the use of personalised features may require the creation of an account. Access to certain features may also depend on the type of profile selected, the User’s status, the verification of certain information or the subscription to a paid service.

Age of the user

General access to Entraide Maritime is reserved for persons aged 18 or over. Persons aged 16 to 17 may nonetheless access certain limited features, in particular the search for work placements and educational content, on the conditions provided by the Platform and, where required, with the authorisation of their legal representative. Features involving transactions or reserved for adults are not accessible to them.

Equipment and connection

The User must have compatible equipment, an internet connection and, more generally, the technical means necessary to access the Platform. The costs relating to this equipment and to the internet connection remain the User’s responsibility. Entraide Maritime endeavours to ensure the accessibility and proper operation of the Platform. However, access may be temporarily interrupted or limited, in particular for maintenance, updates or security operations, in the event of a technical incident or for any other reason necessary for the proper operation of the service. Certain features may be rolled out progressively depending on the versions of Entraide Maritime, the territories concerned or the categories of user. Access to the Platform confers no vested right to the permanent retention of any particular feature, subject to the rights the User enjoys under the applicable regulations and any paid services subscribed to.

Chapter 5 — Creating and managing user accounts

To access certain features of Entraide Maritime, the User must create an account and, where applicable, select the profile corresponding to their activity or use of the Platform. When registering, the User undertakes to provide accurate, complete and up-to-date information. It is the User’s responsibility to update this information as it changes. In the current version of the Platform, a single member account gives access to all the available features; the profile categories described in Chapter 6 will be introduced progressively, as Entraide Maritime develops. Each account is personal to its holder. The User is responsible for the confidentiality of their login credentials and must take the necessary precautions to prevent any unauthorised use of their account. In the event of loss, theft or disclosure of their credentials, or of suspected fraudulent use of their account, the User must change their access details and inform Entraide Maritime as soon as possible by the means made available. Entraide Maritime may set up different levels of verification depending on the nature of the profile or the services used. Additional information or supporting documents may in particular be requested where verification is necessary for security, for trust between users or for compliance with the obligations applicable to the Platform. The User must not create an account under a false identity, impersonate a third party or deliberately provide misleading information. A single User may, where the features of the Platform allow it, hold or manage different profiles corresponding to their activities, subject to compliance with the conditions applicable to each of them. Entraide Maritime reserves the right to temporarily limit access to an account, to request additional verification or to take the measures provided for in these Terms where an anomaly, fraud, identity theft or a breach of the Platform’s rules is identified or reasonably suspected. The arrangements relating to the suspension, deletion and closure of accounts are set out in the corresponding chapters of these Terms.

Chapter 6 — Profiles and categories of user

Entraide Maritime provides access to different types of profile in order to adapt the Platform’s features to the needs of private individuals, professionals and companies in the maritime and boating sector. When registering or using certain services, the User may be required to select a profile category corresponding to their situation, activity or needs. The Platform may in particular offer profiles intended for:

  • private individuals and recreational boaters;
  • seafarers and professionals in the maritime sector;
  • independent professionals and service providers;
  • companies and recruiters;
  • owners or persons looking for a boat;
  • bodies, schools or professionals offering training or content;
  • as well as any other category of user added to Entraide Maritime at a later date.

The features, access rights and services available may vary according to the profile category used. Until these categories are activated, each member has a single account giving access to all the available features. Where a User presents themselves as a professional, a company or a training body, or carries on a regulated activity, they are responsible for the accuracy of their status and of the information provided to Entraide Maritime and to other users. Creating a profile on Entraide Maritime does not in itself constitute certification of the skills, qualifications, diplomas, authorisations or professional capabilities of its holder. Entraide Maritime may nonetheless put in place verification mechanisms making it possible to identify certain profiles, documents or information that have been checked in accordance with the arrangements provided by the Platform. The User undertakes to use the profile category that genuinely corresponds to their situation and to inform Entraide Maritime of any change liable to affect their status or the use of the associated services.

Chapter 7 — Features and services offered

Entraide Maritime is intended to bring together progressively various digital services for private individuals, professionals, companies and other players in the maritime and boating sector. Depending on the various development phases of the Platform, Users may in particular access the following features:

  • searching for and publishing job offers and job requests in the maritime sector;
  • connections between seafarers, professionals, companies, recruiters, private individuals and other players in the sector;
  • publishing and consulting listings relating in particular to the purchase and sale of boats;
  • searching for, offering and connecting people in relation to maritime or boating services and work;
  • access to educational content, courses and training offered directly or through referenced professionals and bodies;
  • community spaces for exchanges and the sharing of information, experience and mutual assistance between users;
  • messaging and communication tools enabling exchanges between users;
  • a search, filtering and recommendation system adapted to the various profiles;
  • features for saving listings, content or profiles as favourites;
  • tools for publishing and managing content;
  • maritime assistance based on artificial intelligence technologies;
  • as well as any new service or feature developed subsequently as Entraide Maritime evolves.

Certain features may be free of charge while others may require a subscription, payment for a service, the application of a commission or any other pricing arrangement set out in the Terms of Sale. The availability of features may vary according to the version of the Platform, the type of profile, the territory concerned, the eligibility conditions or the User’s subscription level. Entraide Maritime may develop its features in order to improve its services, meet users’ needs, strengthen the security of the Platform or pursue its development. The specific conditions applicable to certain services, in particular publications, connections, transactions, community spaces and artificial intelligence features, are set out in the corresponding chapters of these Terms.

Chapter 8 — Publishing listings and content

Entraide Maritime allows Users, according to their profile and the features available, to publish listings, offers, requests, messages, photographs, documents and other content connected with the services offered by the Platform. The User remains responsible for the content they publish and undertakes to provide information that is accurate, fair, sufficiently precise and up to date. Any publication must be directly connected with the purpose of Entraide Maritime and must comply with these Terms, the moderation charter and the applicable regulations. It is prohibited in particular to publish:

  • deliberately false, misleading or fraudulent information;
  • listings concerning illegal activities or services;
  • content infringing the rights, reputation or privacy of a third party;
  • hateful, discriminatory, threatening, violent or manifestly unlawful content;
  • content infringing the intellectual property rights of a third party;
  • listings or content intended to divert Users away from the Platform fraudulently;
  • malware, fraudulent links or content liable to compromise the security of the Platform or of its Users.

The User warrants that they hold the rights and authorisations necessary in respect of the texts, photographs, videos, documents and other elements they publish. Listings must be placed in the appropriate categories and must present their subject sufficiently clearly. Where a listing concerns a boat, a service, a job offer, a training course or any other service requiring specific information, the User is responsible for its accuracy and its compliance with the applicable regulations. Entraide Maritime may provide tools for reporting content or a listing that may not comply with the Platform’s rules. Entraide Maritime may moderate, limit the visibility of or remove content on the conditions provided for in these Terms and by the moderation charter, in particular where it is manifestly unlawful, fraudulent or contrary to the rules applicable to the Platform. Publishing content on Entraide Maritime does not entail any transfer of ownership to the Platform. The conditions necessary for the display, hosting and technical operation of this content are set out in the chapter on intellectual property.

Chapter 9 — Connecting users

Entraide Maritime offers features intended to make it easier to connect private individuals, professionals, companies and other players in the maritime and boating sector. These connections may in particular concern:

  • job offers and job searches;
  • maritime or boating services and work;
  • the purchase and sale of boats;
  • training and content offered by professionals or bodies;
  • requests for assistance or mutual aid;
  • as well as the other services progressively integrated into the Platform.

Entraide Maritime provides the digital tools enabling Users to search for, identify and contact other users according to their needs. Except where a service offered directly by Entraide Maritime expressly states otherwise, the Platform acts primarily as a technical intermediary for connecting people. Users remain responsible for the exchanges, commitments and agreements concluded between them. Each User is responsible for checking, before entering into a commitment with another user, the information, skills, qualifications, insurance, authorisations, documents or other elements necessary for the service or activity concerned. Where Entraide Maritime puts in place a system for verifying certain profiles or documents, this verification relates solely to the elements expressly indicated as verified by the Platform and does not constitute a general warranty concerning the User, their skills or the proper performance of a service. Users undertake to use the connection tools fairly and not to use the Platform for fraudulent or unlawful purposes or purposes contrary to these Terms. Where certain connections give rise to a transaction, a commission or a paid service offered by Entraide Maritime, the applicable financial conditions are set out in the Terms of Sale and, where applicable, in the specific conditions of the service concerned. In the event of a difficulty between Users, Entraide Maritime may provide means of reporting or assistance, without substituting itself for the parties in their respective obligations, except where the applicable regulations or the specific conditions of the service concerned provide for a particular intervention by the Platform.

Chapter 10 — Community spaces and mutual assistance

Entraide Maritime provides Users with community spaces intended to encourage exchanges, the sharing of experience, the transmission of knowledge and mutual assistance around the maritime and boating sector. Depending on the features available, Users may in particular publish content, ask questions, reply to other members, share their experiences and take part in the discussions offered on the Platform. Each User undertakes to behave in a respectful, responsible and constructive manner towards the other members of the community. Exchanges carried out within the community spaces must comply with these Terms and with the Entraide Maritime moderation charter. The following are prohibited in particular:

  • hateful, discriminatory, threatening, violent or harassing remarks;
  • insults and personal attacks;
  • manifestly unlawful or fraudulent content;
  • identity theft;
  • spam and repetitive or manifestly abusive publications;
  • the unauthorised disclosure of personal or confidential data belonging to a third party;
  • content infringing intellectual property rights;
  • any use of the community spaces liable to compromise the security or proper operation of the Platform.

The information, advice and feedback published by Users reflect their own knowledge and opinions. They do not necessarily constitute verified information or professional recommendations validated by Entraide Maritime. In the maritime field, certain decisions may have significant consequences for the safety of persons, vessels or navigation. The User remains responsible for checking the information obtained against appropriate sources and, where the situation requires it, for consulting a competent professional or the authorities concerned. Entraide Maritime may put in place reporting and moderation tools in order to preserve the quality and safety of exchanges. The detailed arrangements for moderation, reporting and the handling of content contrary to the Platform’s rules are set out in the Entraide Maritime moderation charter.

Chapter 11 — Artificial intelligence and maritime assistance

Entraide Maritime is intended to integrate progressively features based on artificial intelligence in order to support Users in their searches, their procedures and their use of the various services of the Platform. Assistance by artificial intelligence may in particular make it possible to direct Users towards relevant information, to make their searches easier, to support them in using the Platform and to provide general assistance on certain topics related to the maritime and boating sector. The answers produced by an artificial intelligence system are generated automatically and may contain errors, approximations or incomplete information. They must therefore not be regarded as systematically accurate or exhaustive. In particular, the assistance offered by Entraide Maritime is not a substitute for the competent authorities, official documents, qualified professionals or the regulatory equipment and services necessary for the safety of navigation. The User remains responsible for checking the information obtained before any decision liable to have consequences for navigation, the safety of persons or property, regulations, the weather, the maintenance of a vessel or any other situation requiring reliable and up-to-date information. The artificial intelligence features of Entraide Maritime do not constitute a distress or rescue system and must not be used as the main means of dealing with an emergency at sea. Entraide Maritime may develop the features, information sources and technologies used in order to improve gradually the quality and relevance of its maritime assistance. Any processing of personal data required for the operation of these features is governed in accordance with the privacy policy applicable to Entraide Maritime.

Chapter 12 — Users’ obligations and responsibilities

Each User undertakes to use Entraide Maritime in a fair and responsible manner and in accordance with these Terms of Use and with the applicable regulations. The User is in particular responsible for the information, documents, listings, messages and content they communicate or publish on the Platform. To that end, the User undertakes in particular to:

  • provide accurate, truthful and up-to-date information;
  • use a profile that genuinely corresponds to their situation or activity;
  • respect the other Users and the rules applicable to the community spaces;
  • hold the rights and authorisations necessary for the content they publish;
  • comply with the legal and professional obligations applicable to their activity;
  • not use Entraide Maritime for fraudulent, misleading or unlawful purposes;
  • not impersonate a third party;
  • not attempt to circumvent or compromise the Platform’s security mechanisms;
  • keep their login credentials confidential;
  • report, where necessary, any behaviour or content liable to undermine the safety of Users or the proper operation of the Platform.

Where a User offers a service, a professional activity, a training course or any other service subject to specific conditions, it is their responsibility to hold the qualifications, diplomas, insurance, authorisations, declarations or other elements required by the applicable regulations. Likewise, Users remain responsible for their decisions when they enter into a relationship with another member of the Platform. They must carry out the checks they consider necessary before entering into a commitment, a service or a transaction. The User is also responsible for the use they make of the information obtained through the community spaces, the other Users or the assistance features offered by Entraide Maritime. Any breach of these Terms may lead, depending on its nature and seriousness, to the limitation of certain features, the removal of content, or the suspension or deletion of the account, on the conditions provided for in these Terms. In the event of a manifestly unlawful activity or where the regulations require it, Entraide Maritime may also take the necessary measures and cooperate with the competent authorities in accordance with the legal obligations applicable to it.

Chapter 13 — Verification of profiles and information

In order to strengthen trust and safety between Users, Entraide Maritime may put in place various mechanisms for verifying profiles and the information provided on the Platform. Depending on the type of profile, the activity carried on or the service used, Entraide Maritime may in particular request the provision of information or supporting documents making it possible to verify certain elements declared by the User. These verifications may in particular concern:

  • the User’s identity;
  • the contact details provided;
  • the professional status or the existence of a company;
  • the diplomas, certificates or qualifications declared;
  • professional insurance where this is necessary;
  • the documents or authorisations relating to certain maritime activities;
  • as well as any other element necessary for the security or proper operation of the services offered.

Where an element has been verified, Entraide Maritime may display a note, a badge or any other indicator making it possible to identify it on the profile concerned. A verification carried out by Entraide Maritime relates solely to the information or documents expressly concerned. It does not constitute a general warranty concerning the skills, reliability, behaviour or quality of the services offered by the User. The User remains responsible for the authenticity, validity and updating of the documents and information provided. Any falsification, fraudulent alteration or use of documents belonging to a third party may lead to the verification being refused and to the measures provided for in these Terms. Entraide Maritime may request a fresh verification where a document expires, where important information is changed or where an additional check appears necessary. The data and documents collected in connection with these verifications will be processed in accordance with the Entraide Maritime privacy policy and with the applicable regulations on the protection of personal data.

Chapter 14 — Moderation and prohibited content

Entraide Maritime puts in place moderation rules intended to preserve the safety, reliability and quality of the exchanges carried out on the Platform. Users are responsible for the listings, messages, comments, images, documents and other content they publish or transmit through Entraide Maritime. The following content or behaviour is prohibited in particular:

  • manifestly unlawful, fraudulent or misleading;
  • hateful, discriminatory, threatening, violent or harassing;
  • infringing the dignity, reputation or privacy of a third party;
  • involving the theft of an identity or of a professional capacity;
  • infringing the intellectual property rights of a third party;
  • offering activities, services or transactions prohibited by the applicable regulations;
  • deliberately containing false documents, false qualifications or untruthful information;
  • disclosing without authorisation personal or confidential data belonging to a third party;
  • constituting spam, an attempted scam or an abusive solicitation;
  • liable to compromise the security, integrity or operation of the Platform.

Entraide Maritime may provide Users with tools for reporting content or behaviour that may breach these Terms. Where content or behaviour is reported or identified, Entraide Maritime may carry out the necessary checks and take a measure proportionate to the nature and seriousness of the situation. These measures may in particular include the removal or limitation of visibility of content, the sending of a warning, the restriction of certain features or, in the situations provided for in these Terms, the suspension or deletion of an account. Where the circumstances allow and subject to the applicable legal obligations, Entraide Maritime may inform the User concerned of the measure taken and of its reason. The detailed arrangements concerning the reporting procedures, the principles of moderation and the handling of content will also be the subject of a separate Moderation Charter, accessible from the Platform.

Chapter 15 — Suspension and deletion of accounts

Entraide Maritime may take measures against an account where a User does not comply with these Terms of Use, the Platform’s rules or the applicable regulations. Depending on the nature, seriousness or repetition of the breach identified, Entraide Maritime may in particular:

  • issue a warning to the User;
  • request the modification or removal of content;
  • temporarily limit certain features;
  • temporarily suspend the account;
  • permanently delete the account in the most serious situations or in the event of repeated breaches.

A suspension or deletion may in particular occur in the event of fraud, identity theft, the provision of false documents, abusive behaviour, the publication of manifestly unlawful content, an attack on the security of the Platform or of Users, or use contrary to the purpose of Entraide Maritime. Where the situation allows and subject to the applicable legal obligations, Entraide Maritime may inform the User concerned of the measure taken and of its reason. In the event of an immediate risk to the security of the Platform or of its Users, of serious fraud or where the law requires it, Entraide Maritime may take the necessary measures without prior warning. The User may also request the closure of their account in accordance with the arrangements made available on the Platform. The closure, suspension or deletion of an account does not necessarily entail the immediate deletion of all the associated data. Certain information may be retained for the periods necessary for compliance with legal obligations, the management of disputes, the prevention of fraud or the defence of Entraide Maritime’s rights, in accordance with the applicable privacy policy. The possible consequences of closing an account for a subscription, a transaction or another paid service are set out in the applicable Terms of Sale.

Chapter 16 — Liability of Entraide Maritime

Entraide Maritime endeavours to ensure the proper operation, availability and security of the Platform as well as the quality of the services offered, within the limits of its legal obligations and of the means reasonably implemented. Entraide Maritime cannot, however, guarantee permanent and uninterrupted availability of the Platform. Access to it may in particular be temporarily limited in the event of maintenance, an update, a technical incident, the failure of a third-party service or a need connected with security. Where the Platform acts as an intermediary for connecting people, Entraide Maritime is not a party to the commitments concluded directly between Users, except where it is expressly stated that a service is provided directly by Entraide Maritime. Entraide Maritime does not guarantee the proper performance of a service, a contract, a sale, a recruitment or any other commitment concluded between Users. Each User remains responsible for the checks necessary before entering into a commitment with a third party. The content, listings, information, advice and documents published by Users remain the responsibility of their authors. Entraide Maritime may nonetheless intervene in accordance with these Terms and its Moderation Charter where content is reported to it or where an intervention is necessary. The information available on the Platform, in particular that from the community spaces or the artificial intelligence features, does not replace official information, the advice of a qualified professional or the regulatory systems for navigation, safety and rescue. Entraide Maritime cannot be released from the responsibilities that fall to it by law. No provision of these Terms is intended to limit or exclude the rights that Users enjoy under mandatory legal provisions. The User remains responsible for the use they make of the Platform, for the information they provide and for the decisions they take on the basis of the services offered.

Chapter 17 — Third-party services, content and links

Entraide Maritime may allow Users to access content, services, tools or sites offered by third parties, in particular in connection with partnerships, connections or features integrated into the Platform. These third-party services may be subject to their own terms of use, privacy policies, commercial terms or other contractual rules. It is for the User to read them before using them. The presence of a link, a piece of content or a third-party service on Entraide Maritime does not necessarily mean that the Platform guarantees or approves all the information, services or practices of the third party concerned. Where a service or work is provided directly by a professional, a company, a body or another User, that party remains responsible for its offer and for compliance with the legal and contractual obligations applicable to it. Entraide Maritime cannot be held liable for acts, content or services falling exclusively within the responsibility of a third party, subject to the responsibilities that fall to it under the applicable regulations. Users are invited to check the conditions, information and warranties applicable before subscribing to or using a service offered by a third party.

Chapter 18 — Intellectual property

Entraide Maritime and the elements that make up the Platform, in particular its trade mark, its logo, its visual identity, its organisation, its interfaces, its texts, its illustrations, its graphic elements and, more generally, the content created for its operation, are protected by the applicable intellectual property rights. Save prior authorisation or a legal provision to the contrary, any unauthorised reproduction, representation, modification, extraction, re-use or exploitation of these elements is prohibited. The use of the Platform confers on the User no ownership right over Entraide Maritime or over the protected elements that make it up. Users remain the owners of the content they publish on the Platform and warrant that they hold the rights necessary to use and distribute it. By publishing content on Entraide Maritime, the User authorises the Platform, to the extent necessary for the operation of the service, to host, store, technically reproduce and display that content in order to allow its publication and consultation by the Users concerned. This authorisation is limited to the needs of operation, presentation, promotion of the content within the Platform and provision of the Entraide Maritime services. It does not transfer ownership of the content to Entraide Maritime. The User must not publish content infringing the intellectual property rights of a third party. Any content liable to constitute an infringement of these rights may be reported and handled in accordance with the moderation procedures provided by Entraide Maritime.

Chapter 19 — Protection of personal data

In connection with the use of Entraide Maritime, certain personal data may be collected and processed in order to enable the operation of the Platform and the provision of its various services. This processing may in particular concern the data necessary for the creation and management of accounts, the verification of profiles, connections, communications between Users, the security of the Platform, the management of the services subscribed to and compliance with the applicable legal obligations. Entraide Maritime undertakes to process personal data in accordance with the applicable regulations, in particular the General Data Protection Regulation (GDPR) and the applicable national provisions. Users have the rights provided for by the regulations on the protection of personal data, according to the conditions applicable to each processing operation. Detailed information concerning, in particular, the categories of data collected, the purposes of processing, their legal bases, the recipients, the retention periods, any data transfers and the arrangements for exercising rights will be set out in the Entraide Maritime Privacy Policy. This Privacy Policy will be accessible from the Platform and will constitute the reference document concerning the processing of Users’ personal data.

Chapter 20 — Cookies and trackers

Entraide Maritime may use cookies and other trackers necessary for the operation, security and improvement of the Platform. Certain strictly necessary cookies may be used in order to enable, in particular, the authentication of Users, the securing of accounts, the retention of certain settings and the technical operation of the services. Other cookies or trackers may, depending on the features put in place, be used for audience measurement or personalisation purposes or to enable the use of certain services offered by third parties. Where the regulations require it, these cookies and trackers will be placed or used only after the User’s consent has been obtained. The User may accept, refuse or change their choices through the cookie management tool made available to them. Refusing non-necessary cookies must not prevent access to the essential features of the Platform. Certain optional features depending on a particular service or tracker may however be affected. Detailed information concerning the cookies and trackers used, their purpose, their retention period and the arrangements for managing consent will be set out in the Entraide Maritime Cookie Policy.

Chapter 21 — Security of the platform

Entraide Maritime implements technical and organisational measures intended to ensure the security of the Platform, of User accounts and of the data processed in connection with its services. The User is also responsible for the security of their account. They must in particular keep their login credentials confidential, use sufficiently secure means of authentication and not disclose their access details to a third party. Any attempt to compromise the security or operation of Entraide Maritime is prohibited. It is prohibited in particular to:

  • attempt to access without authorisation an account, a piece of data, a server or a protected part of the Platform;
  • introduce or distribute malicious programs, files or content;
  • circumvent the security or access-control mechanisms;
  • deliberately disrupt the operation or availability of the services;
  • fraudulently exploit a vulnerability or a security flaw.

Where a User identifies or suspects a compromise of their account, a vulnerability or an incident liable to affect the security of the Platform, they are invited to inform Entraide Maritime as soon as possible via the contact means provided. Entraide Maritime may take any technical measure necessary to protect the Platform and its Users, in particular temporarily limiting access, requiring a reset of the means of authentication or suspending certain features where a security risk is identified. In the event of an incident concerning personal data, Entraide Maritime will apply the procedures and obligations provided for by the applicable regulations on data protection.

Chapter 22 — Paid services and Terms of Sale

As at the date of this version, Entraide Maritime is entirely free and offers no paid service; no payment may be required of the User. Entraide Maritime may in the future offer certain free services as well as paid features or services accessible according to the User’s profile and needs. Paid services may in particular include subscriptions, premium features, professional services, commissions relating to certain connections or transactions as well as other services developed progressively by Entraide Maritime. The prices, payment arrangements, renewal conditions, applicable commissions and any cancellation or refund conditions will be presented to the User before any subscription or transaction concerned. Where applicable, paid services will be governed by the Entraide Maritime Terms of Sale, which will supplement these Terms of Use. In the event of a contradiction specifically concerning a paid service, the specific provisions set out in the Terms of Sale or in the conditions specific to the service concerned will prevail for the elements relating to that transaction. No payment will be considered due solely on account of the use of a service presented as free on the Platform. Any paid subscription must be the subject of clear information about its price and its main conditions before it is confirmed by the User.

Chapter 23 — Changes to the services and the Terms

Entraide Maritime is an evolving platform. Its features, services and terms of use may be adapted as it develops, in particular in order to integrate new services, improve the user experience, strengthen security or respond to technical, commercial, regulatory or legal changes. Entraide Maritime may thus modify, add, replace or remove certain features, subject to compliance with Users’ rights and with the commitments applicable to any paid services in progress. These Terms of Use may also be amended in order to reflect changes to the Platform, its services or the applicable regulations. The applicable version of the Terms will be accessible at all times from the Platform and will show its last update date. In the event of a substantial change affecting Users’ rights or obligations, Entraide Maritime may inform them by an appropriate means. Where the nature of the change or the applicable regulations require it, fresh acceptance of the Terms may be requested before the User is allowed to continue using the services concerned. Changes may not deprive Users of the rights guaranteed to them by the applicable mandatory legal provisions.

Chapter 24 — Duration and termination

These Terms of Use apply throughout the User’s use of Entraide Maritime. The User may stop using the Platform at any time and request the closure of their account in accordance with the arrangements made available by Entraide Maritime. Closing the account entails the end of access to the features requiring identification, subject to the operations, obligations or commitments that remain in progress at the time of closure. Where a User has a subscription or a paid service, the arrangements for termination, renewal and refund and any financial consequences are defined in the Terms of Sale or in the specific conditions applicable to the service concerned. Entraide Maritime may suspend or delete an account in the event of non-compliance with these Terms, in accordance with the conditions set out in the chapter on the suspension and deletion of accounts. The closure or deletion of an account does not necessarily entail the immediate erasure of all the associated data. Certain information may be retained where this is necessary for compliance with a legal obligation, the prevention of fraud, the management of a dispute or the defence of Entraide Maritime’s rights. The arrangements relating to the retention and deletion of personal data are set out in the Entraide Maritime Privacy Policy.

Chapter 25 — Governing law and dispute resolution

These Terms of Use are governed by French law, subject to any mandatory provisions applicable to Users residing in another State. In the event of a difficulty or dispute relating to the use of Entraide Maritime, the parties are invited to seek an amicable solution as a priority. The User may contact Entraide Maritime via the contact means made available on the Platform in order to submit their request or complaint. Where a User acts as a consumer, they enjoy the rights and remedies provided for by the applicable regulations. Where the legal conditions are met, they may in particular have free recourse to a consumer mediation scheme after first sending a complaint to Entraide Maritime. The contact details of the competent consumer mediator will be provided in the relevant legal documents once one has been appointed. Failing an amicable resolution, the dispute may be brought before the competent courts in accordance with the applicable legal rules. No provision of these Terms may have the effect of depriving a consumer of the mandatory rules of jurisdiction or protection that they enjoy under the applicable regulations.

Chapter 26 — Contact

For any question relating to the use of Entraide Maritime, to these Terms of Use, to the operation of an account or to a service offered by the Platform, the User may contact Entraide Maritime via the contact means made available to them. The official contact details will be indicated on the Platform as well as in the Entraide Maritime Legal Notice. Requests concerning personal data and the exercise of the rights provided for by the applicable regulations must be sent in accordance with the arrangements set out in the Privacy Policy. Reports concerning content, behaviour or a listing may be made using the reporting mechanisms available on the Platform or in accordance with the arrangements set out in the Moderation Charter. Entraide Maritime will endeavour to handle the requests received within a reasonable time, according to their nature, their complexity and the applicable legal obligations.
