Chapter 1 — Purpose of the privacy policy
1.1 Purpose
The purpose of this Privacy Policy is to inform Entraide Maritime users about how their personal data is collected, used, stored and protected when they use the platform.
It also sets out the rights users have in relation to their personal data and how to exercise them.
1.2 Scope
This policy applies to the processing of personal data carried out in connection with the services offered by Entraide Maritime, in particular when creating and using an account, publishing content, connecting with others, using the messaging system, the maritime AI assistant and paid services.
It also applies to the data needed for the security, moderation and proper operation of the platform.
1.3 Minors
General access to Entraide Maritime is intended for people aged 18 or over.
Users aged 16 to 17 may however access certain limited features, in particular searching for internships, courses and educational content, and the maritime AI assistant, under the conditions set by Entraide Maritime.
Features involving transactions or services reserved for adults are not available to them.
1.4 Protection principles
Entraide Maritime undertakes to process personal data in accordance with the applicable regulations, in particular the General Data Protection Regulation (GDPR).
The data collected must be adequate, relevant and limited to what is necessary for the services concerned to operate.
Chapter 2 — Data controller and GDPR contact
2.1 Data controller
Entraide Maritime is the controller of the personal data collected in connection with the services it provides directly and determines, for that processing, the purposes and means used.
The legal information identifying Entraide Maritime is given at the beginning of this Privacy Policy.
2.2 Contact regarding personal data
For any question about the use of their personal data or the exercise of their rights, users may contact Entraide Maritime at the following address: Contact regarding data protection: contact@entraidemaritime.com.
Entraide Maritime handles requests relating to personal data under the conditions and within the time limits set by the applicable regulations.
2.3 External providers
Entraide Maritime may use technical providers to carry out certain functions necessary for the platform to operate.
Where these providers process personal data on behalf of Entraide Maritime, they must offer appropriate safeguards regarding confidentiality, security and data protection, in accordance with the applicable regulations.
Chapter 3 — Personal data collected
3.1 Account data
When an account is created and used, Entraide Maritime may collect the information needed to identify the user and operate the profile.
Data needed to create the account: email address, password and display name (or pseudonym). Depending on the profile chosen, the user may then add their first and last name, a home town or port and, optionally, a telephone number.
The information requested may vary depending on the type of profile and the services used.
3.2 Professional and maritime data
Depending on their profile, users may in particular provide:
- Professional experience;
- Maritime diplomas, certificates and qualifications;
- CV and supporting documents;
- Availability and search areas;
- Information relating to their professional activity;
- Photographs and content associated with the profile.
Only data useful for the features concerned should be collected.
3.3 Data related to platform use
Entraide Maritime may process the information generated when its services are used, in particular posts, comments, messages, searches, applications, listings, reports and interactions with the maritime AI assistant.
Technical data needed for the operation and security of the platform may also be collected, in particular connection information and data used to detect fraudulent or abnormal use.
3.4 Sensitive data and supporting documents
Entraide Maritime does not ask users to provide sensitive data that is not necessary for the service used.
Where verifying a profile, a qualification or a transaction requires a supporting document or ID, only the information necessary for that verification is processed, under the conditions set out in this Privacy Policy.
Chapter 4 — Purposes and legal bases of processing
4.1 Purposes of processing
Entraide Maritime processes personal data only where it is necessary for specified purposes, in particular to:
- Create and manage user accounts;
- Provide the platform’s features and services;
- Enable connections, applications and searches;
- Operate the messaging system and the maritime AI assistant;
- Manage subscriptions, payments and billing;
- Ensure security and moderation and prevent fraud;
- Respond to requests, complaints and legal obligations;
- Improve the operation and quality of the services.
4.2 Legal bases
Depending on the processing concerned, Entraide Maritime relies on one of the legal bases provided for by the applicable regulations:
- Performance of a contract or pre-contractual measures requested by the user;
- Compliance with a legal obligation;
- The legitimate interest of Entraide Maritime, in particular to ensure security, prevent fraud and improve its services;
- The user’s consent where it is required.
4.3 Use limitation
Personal data is not used in a way that is incompatible with the purposes for which it was collected.
Where new processing requires the user’s consent, that consent is requested before the data concerned is used.
Chapter 5 — Profiles, location and identity verification
5.1 Profile data
Users may complete their profile with the information needed for the services they wish to use.
Some information may be visible to other users where this is necessary for a connection, an application, a listing or a service. The user is informed whether the information concerned is public or private.
5.2 Location
Entraide Maritime favours the use of a location declared by the user, such as a town, a port or a geographic area, in particular for job offers, internships, boats, services and listings.
A more precise location may be used for certain features, in particular for companies or professionals wishing to indicate their exact position, only where the user authorises it and where that information is necessary for the service concerned.
5.3 Identity and qualification verification
To keep the platform secure, Entraide Maritime may ask for verification of certain information, in particular identity, diplomas, certificates, professional qualifications or other necessary supporting documents.
These checks are carried out only where they are necessary for security, for the reliability of a profile, for a transaction or to comply with a legal obligation.
5.4 Data minimisation
Entraide Maritime limits the collection of verification documents and information to what is necessary for the purpose pursued.
Access to this data is limited to authorised persons or providers, and its retention is governed by the periods set out in this Privacy Policy.
Chapter 6 — Messaging, posts and moderation
6.1 Private messaging
Entraide Maritime may provide a messaging system allowing users to communicate directly.
Private messages are intended solely for the participants concerned. Entraide Maritime does not freely access the content of private conversations.
Limited access may nevertheless be carried out where it is necessary to handle a report, prevent fraud, ensure the security of the platform, enforce the Terms of Use or comply with a legal obligation.
6.2 Posts and content
Posts, comments, listings and other content made public by the user may be viewed by other users depending on the platform’s settings and features.
The user remains responsible for the personal information they choose to make public.
6.3 Reports and moderation
Entraide Maritime may process the content, reports and information needed to prevent fraudulent, unlawful, dangerous behaviour or behaviour contrary to the platform’s rules.
Where necessary, Entraide Maritime may keep the material useful for examining a report, resolving a dispute or protecting its users.
6.4 Confidentiality and access
Access to private messages, reports and moderation data is limited to authorised persons or providers who need it to carry out their task.
Entraide Maritime implements measures designed to prevent any unjustified access to this information.
Chapter 7 — AI assistant and use of content
7.1 How the AI assistant works
Entraide Maritime may offer an AI assistant specialised in the maritime field to help, inform and guide users.
To provide its answers, the assistant may use the information provided by the user as well as the content it is authorised to access on the platform, in particular the courses, posts and maritime information available.
7.2 Processing of exchanges
Questions, messages and information sent to the AI assistant may be processed in order to generate an answer, ensure the security of the service, detect abuse and improve the quality of the assistant’s operation.
Entraide Maritime limits the use of this data to what is necessary for the purposes concerned.
7.3 Reliability and security
Entraide Maritime implements mechanisms to improve the reliability of the information provided by the assistant and to favour, where necessary, verification against appropriate sources.
The AI assistant does not, however, replace a professional, a competent authority or an emergency service. Where the situation requires, the user may be directed to the appropriate service or professional.
7.4 Data protection
Personal data used in connection with the AI assistant is subject to the same principles of confidentiality, security and limitation as the other data processed by Entraide Maritime.
Any technical providers needed for the AI assistant to operate are subject to the rules applicable to external providers set out in this Privacy Policy.
Chapter 8 — Payments and billing data
8.1 Payment processing
As at the date of this version, Entraide Maritime is entirely free: no payment is processed and no bank details are collected. The provisions of this chapter will apply only if paid services are introduced in the future; in that case, payments would be processed by an external payment service provider and full bank details would not be kept by Entraide Maritime.
The full bank details needed to carry out a payment are processed by the provider concerned and are not intended to be kept directly by Entraide Maritime.
8.2 Data processed by Entraide Maritime
Entraide Maritime may keep the information needed to manage transactions and billing, in particular the user’s identity, the service concerned, the amount, the date, the payment status and the transaction references needed to track the operation.
8.3 Billing and legal obligations
The data needed to issue invoices and to comply with accounting, tax or legal obligations may be kept for the periods required by the applicable regulations.
8.4 Payment security
Entraide Maritime selects payment solutions suited to its services and limits its access to financial information to what is necessary to manage transactions, refunds, payment incidents and any fraud.
Chapter 9 — Communications and advertising
9.1 Service-related communications
Entraide Maritime may send users the communications needed for the operation of their account and the services used, in particular information about subscriptions, transactions, security or significant changes to the platform.
9.2 Marketing communications
Entraide Maritime may occasionally send information about its new features, services, offers or news that may be of interest to the user.
Where consent is required, these communications are sent only after the user’s agreement. The user may unsubscribe at any time using the methods indicated in each communication.
9.3 Maritime advertising
Entraide Maritime may display adverts and sponsored content relating to the maritime sector.
The platform favours contextual advertising linked to its world and its services, without setting up complex individual advertising profiling where this is not necessary.
9.4 Cookies and trackers
Where cookies or other trackers are used for advertising, statistical or personalisation purposes, their use is governed in accordance with the applicable regulations.
The detailed arrangements for these technologies are set out in the Entraide Maritime Cookie Policy.
Chapter 10 — Recipients and external providers
10.1 Access to data
Personal data is accessible only to authorised persons within Entraide Maritime and to providers who need it to operate the services concerned.
Entraide Maritime does not sell its users’ personal data.
10.2 Technical providers
Entraide Maritime may use external providers, in particular for:
- Hosting and storing data;
- Sending emails and notifications;
- Operating the AI assistant;
- Security and fraud prevention;
- The technical, statistical and support tools needed for the platform.
Where these providers process data on behalf of Entraide Maritime, their access is limited to the information necessary for their task.
10.3 Disclosure to third parties
Certain data may be disclosed where this is necessary to provide a service requested by the user or where the law requires it.
In particular, Entraide Maritime may be required to provide certain information to the competent administrative or judicial authorities under the conditions provided for by the regulations.
10.4 Choice of providers
Entraide Maritime selects its providers taking into account the safeguards they offer regarding confidentiality, security and personal data protection.
The list or identity of certain providers may be specified or updated according to the solutions actually used by the platform.
10.5 Providers currently used
As at the date of this version, Entraide Maritime uses the following providers: Automattic Inc. (WordPress.com), in the United States, to host the site and the data; Open-Meteo (Germany) for marine weather data; OpenStreetMap / Nominatim (OpenStreetMap Foundation) for the base map and geocoding; the unpkg content delivery network to load the Leaflet mapping library. These services receive the visitor’s IP address when they are called. No payment provider or advertising audience-measurement tool is used.
Chapter 11 — Transfers of data outside the European Economic Area
11.1 Principle
Where possible, Entraide Maritime favours processing and hosting personal data within the European Economic Area (EEA).
However, some technical providers used by the platform may be established outside that area or process certain data there.
11.2 Applicable safeguards
Where a transfer of personal data outside the EEA is necessary, Entraide Maritime ensures that it is carried out in accordance with the applicable regulations.
Depending on the situation, the transfer may in particular rely on an adequacy decision of the European Commission, standard contractual clauses or any other safeguard recognised by the regulations.
11.3 Limitation of transfers
Entraide Maritime limits the data transferred to what is strictly necessary for the operation of the service concerned.
The choice of future technical providers will take into account, in particular, their conditions for processing, storing and protecting personal data.
Chapter 12 — Retention periods
12.1 General principle
Entraide Maritime keeps personal data only for the period necessary to achieve the purposes for which it was collected, subject to legal obligations requiring longer retention.
12.2 User account
Account data is kept for as long as the platform is used.
If the account is deleted or closed, data that is no longer necessary is deleted or anonymised within a reasonable time, except where temporary retention is necessary to comply with a legal obligation, prevent fraud, ensure security or handle a dispute.
12.3 Professional data and content
CVs, qualifications, professional documents, posts, messages and other content are kept for the period necessary for the service concerned.
The user can delete or change the information where the platform’s features allow it.
12.4 Data subject to a retention obligation
Invoices, transaction information and other documents that must be kept in application of an accounting, tax or legal obligation are archived for the period provided for by the applicable regulations.
Once the applicable retention periods expire, the data is deleted, anonymised or archived where the law requires it.
Chapter 13 — Security and data protection
13.1 Security measures
Entraide Maritime implements appropriate technical and organisational measures to protect personal data against unauthorised access, loss, alteration, disclosure or fraudulent use.
These measures are adapted to the nature of the data processed, the services offered and the risks identified.
13.2 Access to data
Access to personal data is limited to authorised persons and providers who need it to carry out their tasks.
Control, authentication and access-management measures may be put in place to limit unauthorised access.
13.3 Security incidents
In the event of a personal data breach that presents a risk to users, Entraide Maritime takes the measures necessary to limit its consequences.
Where the regulations require it, the incident is notified to the competent supervisory authority and the users concerned are informed.
13.4 Users’ responsibility
Each user must contribute to the security of their account, in particular by protecting their credentials and by not disclosing their password to a third party.
Any suspicion of fraudulent access to or unauthorised use of the account must be reported to Entraide Maritime as soon as possible.
Chapter 14 — Users’ rights and account deletion
14.1 Rights relating to personal data
In accordance with the applicable regulations, users may, depending on their situation, exercise the following rights in relation to their personal data:
- Right of access;
- Right to rectification;
- Right to erasure;
- Right to restriction of processing;
- Right to object;
- Right to data portability;
- Right to withdraw consent where processing is based on it.
14.2 Exercising rights
Users may exercise their rights by contacting Entraide Maritime at the address given in the legal information of this Privacy Policy.
Entraide Maritime may request the information strictly necessary to verify the identity of the person making the request where a reasonable doubt exists.
14.3 Account deletion
Users may request the deletion of their account using the features provided on the platform or by contacting Entraide Maritime.
Deleting the account leads to the deletion or anonymisation of data that is no longer necessary. Certain information may however be kept where a legal obligation, a dispute, fraud prevention or the security of the platform justifies it.
14.4 Complaint to the CNIL
If users consider that their rights relating to their personal data are not respected, they may lodge a complaint with the Commission nationale de l’informatique et des libertés (CNIL), the French authority responsible for data protection.
Chapter 15 — Amendment, complaints and entry into force
15.1 Amending the policy
Entraide Maritime may amend this Privacy Policy to reflect changes to its services, its data processing or the applicable regulations.
In the event of a significant change concerning the use of personal data, the users concerned are informed by an appropriate means.
15.2 Complaints
For any question or complaint about the processing of their personal data, users may contact Entraide Maritime using the contact details given at the beginning of this document.
They also retain the option of referring the matter to the CNIL under the conditions provided for by the applicable regulations.
15.3 Entry into force
This Privacy Policy enters into force on the date given in the information at the beginning of the document.
The applicable version is the one made available on Entraide Maritime at the time the services concerned are used.
15.4 Availability
The Privacy Policy is accessible from the Entraide Maritime platform so that users can consult it at any time.
